These Terms of Service ("Terms") govern your access to and use of the SecuredStays platform, website, and all services operated by SecuredStays LLC, a Florida limited liability company and wholly owned subsidiary of Grimaxca Enterprises LLC (Wyoming). By creating an account or using any SecuredStays service, you agree to be bound by these Terms in full.
SecuredStays is a technology platform that provides identity verification, background screening coordination, and housing matching services connecting travel healthcare professionals with verified property owners. SecuredStays is not a landlord, property manager, real estate broker, escrow agent, employer, or housing authority.
SecuredStays does not own, manage, control, or inspect any property listed on the platform. All lease agreements are entered into directly between the traveler and the property owner. SecuredStays is not a party to any lease agreement and assumes no obligations under any lease.
SecuredStays does not collect, hold, transmit, or control any rental funds, security deposits, or escrow funds. All financial transactions related to placements are handled exclusively by the approved third-party escrow provider.
SecuredStays does not conduct background screening directly. All screening is performed by TransUnion SmartMove, an independent consumer reporting agency regulated under the Fair Credit Reporting Act (FCRA). SecuredStays is not a consumer reporting agency.
You must be at least 18 years of age to create a SecuredStays account. By registering, you represent that you are 18 or older and that all information you provide is accurate, current, and complete.
You are responsible for maintaining the security of your account credentials. You may not share your account with any other person. Any activity conducted through your account is your sole responsibility.
SecuredStays reserves the right to refuse registration, suspend, or terminate any account at its sole discretion for violation of these Terms, applicable law, or platform policies.
Accounts are non-transferable. You may not sell, transfer, or assign your SecuredStays account to any other person or entity.
Background screening coordinated through the platform is governed by the Fair Credit Reporting Act (FCRA). SecuredStays coordinates screening through TransUnion SmartMove but is not itself a consumer reporting agency.
If screening information contributes to a denial of platform access, SecuredStays will provide the affected applicant with a written adverse action notice containing: (1) notice that screening information was a contributing factor, (2) the name, address, and contact information of the screening provider, and (3) the applicant's right to obtain a free copy of their screening report and to dispute inaccurate information directly with the provider.
SecuredStays communicates all screening outcomes to property owners only as 'Meets Criteria' or 'Does Not Meet Criteria.' No credit score, criminal record detail, eviction detail, or other consumer report information is shared with property owners at any time.
Applicants who believe their screening results are inaccurate must dispute directly with TransUnion SmartMove. SecuredStays cannot modify, override, or correct screening results.
SecuredStays operates in full compliance with the Fair Housing Act (42 U.S.C. § 3601 et seq.) and all applicable state and local fair housing laws. Neither SecuredStays nor any property owner using the platform may discriminate against any person on the basis of race, color, national origin, religion, sex, familial status, disability, or any other characteristic protected by applicable law.
SecuredStays applies objective, consistently applied verification criteria uniformly to all applicants regardless of any protected characteristic.
The Enhanced Assurance Path is a required feature of SecuredStays' fair housing compliance framework, designed to ensure that credit challenges do not result in automatic exclusion from housing access.
Property owners who engage in discriminatory rejection of verified travelers will be immediately removed from the platform and may be reported to the U.S. Department of Housing and Urban Development (HUD) or relevant state fair housing agency.
SecuredStays does not require users to disclose race, color, national origin, religion, sex, familial status, disability, or any other protected characteristic, and does not use such information in any matching or screening decision.
SecuredStays verifies property ownership and reviews submitted photographs, but does not physically inspect, certify, or warrant the condition of any listed property. Verification of ownership is not a representation that the property is habitable, safe, or accurately described.
Travelers are strongly encouraged to conduct their own inspection of any property prior to move-in and to document the property's condition with dated photographs and video upon arrival.
SecuredStays assumes no responsibility for property defects, habitability issues, pest infestations, mold, structural damage, utility failures, or any other condition of a listed property.
If a property is found to be materially different from its listing description, the traveler should contact SecuredStays immediately. Misrepresentation of property condition by an owner is grounds for platform removal. However, SecuredStays cannot compel a refund, lease termination, or any other remedy — these must be pursued through the lease agreement, escrow provider, or applicable law.
SecuredStays does not process, hold, or disburse any rental payments, security deposits, or escrow funds. All such transactions are handled exclusively by the approved third-party escrow provider.
Membership fees paid to SecuredStays are non-refundable once the verification process has been initiated.
The Enhanced Assurance coordination fee of $99 is non-refundable once the Enhanced Assurance process has been initiated.
Monthly rent payments after the first month of tenancy are paid directly between the traveler and the property owner, completely outside of the SecuredStays platform. SecuredStays has no involvement in, responsibility for, or liability related to ongoing rent payments.
SecuredStays is not liable for any failure by either party to fund or disburse escrow, for any dispute regarding escrow funds, or for any loss arising from the escrow process.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SECUREDSTAYS LLC, ITS PARENT COMPANY GRIMAXCA ENTERPRISES LLC, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, PROPERTY DAMAGE, PERSONAL INJURY, OR ANY OTHER LOSS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SECUREDSTAYS' TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO SECUREDSTAYS IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
SecuredStays is not liable for: (a) the acts or omissions of any property owner or traveler on the platform; (b) the accuracy of any property listing; (c) the outcome of any lease agreement; (d) the accuracy of any background screening report; (e) the performance or failure of the escrow provider; or (f) any third-party services integrated with the platform.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, SecuredStays' liability shall be limited to the fullest extent permitted by applicable law.
You agree to defend, indemnify, and hold harmless SecuredStays LLC, Grimaxca Enterprises LLC, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your interactions with any other user of the platform; or (e) any dispute between you and another user.
SecuredStays reserves the right to assume exclusive control of any matter subject to indemnification by you, in which case you agree to cooperate fully with SecuredStays in asserting any available defenses.
THE SECUREDSTAYS PLATFORM IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
SECUREDSTAYS DOES NOT WARRANT THAT: (A) THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) ANY LISTING, VERIFICATION RESULT, OR SCREENING OUTCOME IS ACCURATE OR COMPLETE; OR (C) ANY PROPERTY LISTED ON THE PLATFORM IS SAFE, HABITABLE, OR ACCURATELY DESCRIBED.
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute between you and SecuredStays arising out of or relating to these Terms or your use of the platform that cannot be resolved through good-faith negotiation within 30 days shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
YOU AND SECUREDSTAYS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING.
Arbitration shall take place in Hillsborough County, Florida. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.
This arbitration provision does not apply to claims that may be brought and resolved entirely in small claims court.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
For any matters not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Hillsborough County, Florida.
If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
SecuredStays reserves the right to modify these Terms at any time. Material changes will be communicated to registered users via email at least 14 days before taking effect. Continued use of the platform after the effective date constitutes acceptance of the modified Terms.
SecuredStays may suspend or terminate your access to the platform at any time, with or without notice, for any violation of these Terms or applicable law.
Sections governing limitation of liability, indemnification, disclaimer of warranties, and dispute resolution survive any termination of your account or these Terms.
